Arkansas Senate passes unemployment drug testing bill

LITTLE ROCK, Ark (Reuters) - The Republican-led Arkansas state Senate approved a measure on Monday that would require random drug testing of Arkansas residents who receive state unemployment benefits - a plan that the state's Democratic governor said could violate federal law.
The bill, which passed on a 25-5 vote and now goes to a House committee, could affect about 85,000 Arkansas residents currently receiving unemployment benefits.
If the measure becomes law, those seeking unemployment benefits would have to sign a waiver and allow for random drug testing. Those who refuse to sign or who test positive for drugs would not be entitled to benefits.
Some other states have adopted measures making a person discharged from work for failing an employer's drug test on the job ineligible to collect employment benefits, according to the National Conference of State Legislatures.
In Texas, Governor Rick Perry has a proposal in that state's legislature that would require drug tests for both unemployment and welfare recipients. But it has not yet passed a chamber.
The Arkansas bill's sponsor, Republican state Senator Jeremy Hutchinson, said that his measure was "more of an enforcement mechanism than anything else."
"Arkansas law states that you have to be adequately seeking employment, and by that you have to pass a drug test since so many employers require drug tests," Hutchinson said.
He said that 80 percent of the state's employers require a drug test. The unemployment testing, Hutchinson said, would cost the state less than $30,000 a year to administer.
Rita Sklar, director of the American Civil Liberties Union of Arkansas, said the group plans to fight the measure if it becomes law. Governor Mike Beebe, a Democrat, also has issues with the bill.
"We have concerns about whether the bill will put us in violation of the federal unemployment laws administered by the U.S. Department of Labor," said Matt DeCample, Beebe's spokesman. "There are also continued concerns as to whether the cost of implementing such a program would produce any real savings in offset."

Fire official: 2 trapped N.C. children likely dead
DENVER, N.C. (AP) ? Two young children trapped when dirt fell on them at a home construction site Sunday were not expected to be found alive and crews expected to work through the night to recover their bodies, a fire official said.
A father of one of the children called 911 at about 6 p.m. to report what happened, said Lincoln County Emergency Services public information officer Dion Burleson. Crews were on the scene in minutes, but couldn't get to the 7-year-old boy and 6-year-old girl, Burleson said.
Crews used shovels and climbing gear trying to get to the children at the Denver neighborhood. Emergency personnel from several places, including nearby Charlotte, were on the scene late Sunday.
Video from WSOC-TV shows backhoes scooping dirt from a deep hole surrounded by dirt. Equipment surrounded the hole. Burleson said it is hard to estimate how far down the children might be.
The man who called was the father of at least one of the children, Burleson said. Neighbors told WBTV that the children were cousins.
This is "devastating for both the family members and responders who are on the scene," Burleson said. "This is a tragic night in Denver."

EU's Rehn: Big depositors could suffer in future bank bailouts under new law
HELSINKI (Reuters) - Big bank depositors could take a hit under planned European Union law if a bank fails, the EU's economic affairs chief Olli Rehn said on Saturday, but noted that Cyprus's bailout model was exceptional.
"Cyprus was a special case ... but the upcoming directive assumes that investor and depositor liability will be carried out in case of a bank restructuring or a wind-down," Rehn, the European Economic and Monetary Affairs Commissioner, said in a TV interview with Finland's national broadcaster YLE.
"But there is a very clear hierarchy, at first the shareholders, then possibly the unprotected investments and deposits. However, the limit of 100,000 euros is sacred, deposits smaller than that are always safe."
The European Commission is currently drafting a directive on bank safety which would incorporate the issue of investor liability in member states' legislation.
To secure a 10 billion euro EU/IMF bailout last month, Cyprus forced heavy losses on wealthier depositors. Initially it had also pledged to introduce a levy on deposits of less than 100,000 euros - even though they are supposedly protected by state guarantees - before reneging in the face of widespread protests.
Rehn also said that the European Central Bank should launch fresh action to help boost the recession-hit euro zone economy.
ECB President Mario Draghi, at a press conference on Thursday, opened the way for the bank to possibly cut interest rates and to take fresh 'non-standard measures' - steps other than classic rate moves, such as government bond purchases or funding operations like the twin three-year loans it offered banks just over a year ago.
Rehn said that high financing costs for companies, especially in southern Europe, were a major problem right now.
"Therefore, the ECB's talk on Thursday about both standard and non-standard measures is very important because the ECB may have a role in making the situation easier," Rehn said.

ISTANBUL (AP) ? U.S. Secretary of State John Kerry arrived in Turkey early Sunday on the first leg of a 10-day trip to Europe and Asia that would also seek to unlock long-stalled Israeli-Palestinian peace talks.
Kerry was expected to encourage Turkish leaders to continue improving ties with Israel. The two countries were once allies, but relations spiraled downward after Israel's 2010 raid on a Turkish flotilla bound for the Gaza Strip. Eight Turks and one Turkish-American died.
Hopes for rapprochement improved after Obama brokered a telephone conversation between Israeli Prime Minister Benjamin Netanyahu and Turkey's prime minister, Recep Tayyip Erdogan, while President Barack Obama was in Israel last month.
Kerry also will coordinate with Erdogan and other Turkish officials on efforts to halt the violence in neighboring Syria.
Kerry planned to fly from Turkey to Jerusalem for meetings with the presidents and prime ministers of both Israel and the Palestinians. He had accompanied Obama there and made a solo trip to Israel shortly after.
Though expectations are low for any breakthrough on Kerry's trip, his diplomacy represents some of the Obama administration's most sustained efforts for ending more than six decades of conflict between Israelis and Palestinians.
Kerry probably will seek confidence-building measures between the two sides. Negotiators and observers see little chance right now for immediate progress on the big stumbling blocks toward a two-state peace agreement.
Kerry will also visit Britain and then South Korea, China and Japan, where talks will focus on North Korea's nuclear program and escalating threats against the U.S. and its allies.
He is scheduled to return to Washington on April 15.
